Nevada legalized marijuana — does that affect our DOT drug testing program?

No. Federal DOT rules (49 CFR Part 40) are not affected by Nevada's recreational marijuana law (NRS 678C). A marijuana positive on a DOT test is still a violation. MROs cannot cancel a positive result due to a state cannabis authorization. This applies to all FMCSA, FAA, FRA, PHMSA, and FTA-regulated employees in Nevada.
