Drug testing obligations for Amazon FC contractors and staffing agencies - what the law actually requires

Amazon's internal policies for its own workforce are Amazon's responsibility. Your drug testing obligations as a contractor, staffing agency, or 3PL employer are entirely separate and governed by three layers:

Layer 1 - Your written company drug and alcohol policy. If your operation includes CDL drivers operating qualifying commercial motor vehicles - including last-mile delivery vehicles above the CMV weight threshold - those drivers are subject to FMCSA testing under 49 CFR Part 382 and 49 CFR Part 40. This is a federal mandate that applies regardless of who owns the facility where your driver reports. 3PL and last-mile delivery employers in the Amazon network frequently have FMCSA-regulated CDL drivers and must maintain a compliant DOT program independent of Amazon's internal systems.

Layer 3 - State cannabis law in the state where the facility is located. Cannabis law varies by state.
